2. The information we collect
The personal information we collect depends on how you interact with us.
When you submit a project enquiry or otherwise contact us, we may collect your name, business or company name, email address, telephone number, existing website address, the type of service you are interested in, approximate project budget, information about your proposed project and what you would like the project to achieve.
We may also collect information contained in emails or other correspondence you send to us and any information you subsequently provide while discussing or carrying out a project.
If you become a client, we may additionally hold information necessary to manage our business relationship, including billing and invoicing information, project records, contracts, correspondence, files or content supplied for the project and records relating to payments.
When you use our website, certain technical information may also be collected automatically. Depending on the cookies and services enabled on the site, this may include your IP address, browser type, device type, operating system, pages visited, referring website, approximate location information and information about how you interact with the website.
We also maintain records of your cookie and privacy preferences where required.
We do not intentionally collect special category personal information through the website. Please avoid including sensitive personal information in project enquiry forms unless it is genuinely necessary.
3. How we collect your information
We collect personal information directly from you when you complete a form, contact us by email or telephone, discuss a potential project with us, enter into an agreement with us or otherwise provide information to us.
Some technical information is collected automatically through the website, hosting platform, security systems and cookies or similar technologies.
Where relevant to an enquiry or project, we may also review information that you or your business have made publicly available, for example on your existing business website or public business profiles.
4. How and why we use your personal information
We only use personal information where we have a lawful basis for doing so.
Purpose | Lawful basis |
Responding to project enquiries, discussing requirements and preparing proposals or quotations | Taking steps at your request before entering into a contract |
Providing website design, development or related services to clients | Performance of a contract |
Managing client relationships, project communications and administration | Performance of a contract and, where appropriate, our legitimate interests in running our business |
Issuing invoices, maintaining accounting records and complying with tax or other legal requirements | Legal obligation |
Operating, maintaining, securing and troubleshooting our website and business systems | Our legitimate interests in operating and protecting our business |
Maintaining appropriate records and establishing, exercising or defending legal claims | Our legitimate interests |
Using non-essential analytics or similar technologies where consent is required | Consent |
Recording and respecting cookie choices | Legal obligation and legitimate interests in demonstrating compliance |
Where we rely on legitimate interests, we consider whether our interests are necessary and proportionate and whether your rights and interests override them.
Fields marked as required on our enquiry form contain information we need in order to properly consider and respond to your enquiry. If you do not provide the required information, we may not be able to respond fully or prepare an appropriate proposal.
We do not sell your personal information.
Submitting a project enquiry does not subscribe you to a marketing mailing list. If we introduce optional email marketing in future, we will provide an appropriate choice and lawful method of opting in or out.
5. Project enquiry forms and Wix
Our website is built and hosted using Wix.
When you complete the Start a Project form, the information you submit is processed through Wix Forms and may be stored within Wix Forms & Submissions and Wix Contacts.
We use a Wix automation so that, when a project enquiry is submitted, details of that enquiry are sent to our business inbox at enquiries@masteredbydesign.com.
This automation is used only to route and notify us of your enquiry. It does not make automated decisions about whether we accept you as a client, what price you receive or whether a project proceeds.
We do not currently use solely automated decision-making that produces legal or similarly significant effects on individuals.
6. Email and communications
We use Google Workspace to provide our business email services.
If you email us or submit an enquiry that generates an email notification, relevant personal information may therefore be processed through Google Workspace as part of our business communications.
We may retain correspondence where necessary to deal with your enquiry, manage a project, maintain appropriate business records or protect our legal interests.
7. Cookies and similar technologies
Our website uses cookies and may use similar technologies.
Some cookies are necessary for the website to operate securely and correctly. Other cookies, including analytics or measurement technologies, may require your consent before they are used.
Where consent is required, non-essential cookies will not be intentionally activated until you have made the relevant choice through our cookie consent mechanism.
You can change or withdraw your choices through the cookie controls available on the website.
More detailed information about the cookies and technologies used on this website, including their purposes and duration, is provided in our Cookie Policy.
8. Who we share personal information with
We only share personal information where there is a legitimate reason to do so.
Depending on the circumstances, information may be processed by service providers that support the operation of Mastered by Design, including our website hosting and website-management provider, Wix, and our business email provider, Google Workspace.
We may also use professional, accounting, banking, IT or other business service providers where necessary to run Mastered by Design or provide services to clients.
We may disclose personal information to professional advisers, insurers, regulators, courts, law-enforcement authorities or other public bodies where this is reasonably necessary to comply with the law, protect our rights or respond to a lawful request.
Where we engage contractors or other service providers who process personal information on our behalf, we expect them to handle that information appropriately and only for the purposes for which it has been provided.
We do not rent or sell your personal information to third parties.
9. International transfers
Some of the service providers we use operate internationally, which means personal information may sometimes be processed or stored outside the United Kingdom.
Where personal information is subject to a restricted international transfer, we take appropriate steps to ensure that the transfer is lawful.
Depending on the circumstances, this may include relying on UK adequacy regulations or appropriate safeguards such as the UK International Data Transfer Agreement, the UK Addendum to the European Commission Standard Contractual Clauses, or another lawful transfer mechanism.
Further information about the safeguards relevant to your personal information can be requested by contacting us.
10. How long we keep personal information
We do not keep personal information for longer than is reasonably necessary for the purpose for which it was collected.
Information | Typical retention |
Enquiries that do not become client projects | Up to 24 months after our last meaningful contact, unless there is a legitimate reason to retain them longer |
Client project records, contracts and important correspondence | Generally up to 6 years after the client relationship or project ends, where appropriate for business records and potential legal claims |
Accounting, invoicing and tax information | For the period required by applicable tax, accounting and legal obligations |
Cookie consent records | For as long as reasonably required to demonstrate and manage your consent choices |
Analytics and cookie-derived information | In accordance with the relevant service settings and the periods stated in our Cookie Policy |
We may retain information for longer where required by law, where a dispute exists or where it is reasonably necessary to establish, exercise or defend legal claims.
At the end of the relevant retention period, information will be deleted, anonymised or otherwise securely disposed of where appropriate.
11. How we protect your information
We take reasonable technical and organisational measures designed to protect personal information against unauthorised access, misuse, loss, alteration or disclosure.
These measures include using reputable service providers, access controls, password-protected business systems, secure website connections and limiting access to personal information to those who reasonably need it.
However, no website, email system or internet transmission can be guaranteed to be completely secure.
If we become aware of a personal data breach, we will assess and respond to it in accordance with our obligations under applicable data protection law.
12. Your data protection rights
Depending on the circumstances and the lawful basis on which we process your information, you may have the right to ask us for access to the personal information we hold about you, ask us to correct inaccurate or incomplete information, ask us to erase personal information, ask us to restrict how information is used, receive certain information in a portable format, object to certain processing, and withdraw consent where processing is based on consent.
These rights are not all absolute and may not apply in every circumstance.
If you withdraw consent, this does not affect the lawfulness of processing carried out before consent was withdrawn.
We will normally respond to a valid data-protection rights request without undue delay and within one month, subject to the circumstances permitted by law.
To exercise a right, contact:
enquiries@masteredbydesign.com
We may need to ask for information reasonably necessary to confirm your identity before completing a request.
Your right to object
Where we process your personal information on the basis of legitimate interests, you have the right to object to that processing in certain circumstances.
If personal information is ever used for direct marketing, you have an absolute right to object to its use for that purpose.
13. Complaints
If you are concerned about how Mastered by Design has collected or used your personal information, please contact us first so that we have an opportunity to investigate and resolve the issue.
Email: enquiries@masteredbydesign.com
You also have the right to make a complaint to the Information Commissioner's Office, the UK's independent data-protection regulator.
